CALA/Polo Legal Challenge….

The main points

  • Claim submitted to the High Court for a Judicial Review of the Cala and Polo decisions
  • Claim based on decision’s reliance on the outdated and flawed SKM Green Belt Review
  • We are looking for the decision to be quashed
  • The whole process will take months, maybe up to a year

This affects us all…

Once a development is given the green light, other developers jump onto the bandwagon. Chiswell Green is at risk of a further 675 new houses, in addition to the 721 from Cala and Polo.
This is more houses than there currently are in Chiswell Green!

We are currently raising funds to challenge St Albans City & District Council’s legally flawed decision to approve the Taylor Wimpey reserved matters application.

 

Despite recognising the significant harms the proposal would cause to existing residents, we contend that SADC officers misled members of the Planning Committee by advising them that the scheme represented a “high quality” design.  We further contend that members were misled into believing that no additional conditions could be imposed to mitigate the worst of those harms.

 

This challenge is essential to all residents of Chiswell Green.  While we may not be able to prevent development on sites that already have outline permission, we can influence what is ultimately built—and how it affects our community.

 

The Taylor Wimpey site is the first of several major developments planned for the village.  It is therefore vital that we make a stand on this application, so that SADC and future developers understand that existing residents must be treated fairly across all subsequent sites.

 

The specific issues we seek to influence vary between developments, but typically include:
      •     appropriate separation distances between new and existing homes
      •     retention of existing trees, hedgerows, and vegetation
      •     meaningful limits on construction noise, dust, and site traffic
      -     the design and positioning of new buildings to prevent overlooking, overbearing development, and loss of privacy

 

We are also in discussion with certain developers regarding access routes into development sites.  Any improvements that reduce the traffic impact on our village will benefit the whole community.
